Eligibility. Void where prohibited by law.
Big Fish Facebook promotions (the “Promotion”) are open to legal residents of the 50 United States and the District of Columbia, 18 years or older (each, an “Entrant”). Not open to employees or immediate family members (spouses, domestic partners, parents, grandparents, siblings, children and grandchildren) of employees of Big Fish, or its affiliates or advertising/promotion agencies.

To enter, follow the directions provided in the post promoting the Promotion to submit an entry (an “Entry”). Entry must be submitted in English. Any entries missing the above requirements will be immediately disqualified.
Entrant’s proof of submission does not constitute proof of receipt by Big Fish. Big Fish is not responsible for lost, misdirected, late, incomplete, illegible or unintelligible entries or for inaccurate Entry information, whether caused by participant or by any of the equipment or programming associated with or utilized in this sweepstakes, or by any technical or human error that may occur in the processing of entries. Incomplete, duplicate, mechanically reproduced or automated entries are not permitted and will be deemed void. Limit one (1) Entry per Entrant.
The Promotion will begin and end on the date and times specified in the Promotion Post (the “Promotion Period”). All entries must be received within the specified Promotion Period to be eligible.
Prizes. The number and details of prize(s) to be awarded is specified in the Promotion Post (the “Prize”). The approximate retail value of each prize is no more than US$5. The winner is responsible for paying all costs and expenses related to the Prize that are not specifically mentioned, including but not limited to taxes. The winner may be required to sign an Affidavit of Eligibility and Liability/Publicity Release.
Prize Drawing. The Prize will be awarded at a random drawing held at the time and place specified in the Promotion Post. Winner will be notified through private message on Facebook unless otherwise specified in the Promotion Post. If the potential winner cannot be contacted within 2 business days after the selection date, does not otherwise promptly respond to Big Fish’s communications, or does not sign and return any required documentation within the time periods that Big Fish specifies, the potential winner will forfeit the prize, his or her entries will be declared void and an alternate winner may be selected.
Odds of Winning. Odds of winning depend on the number of eligible entries received.
License to Big Fish. Entrant grants to Big Fish a non-exclusive, worldwide, perpetual, irrevocable, sublicensable, transferable, fully paid up license to use, reproduce, display, distribute and modify the Entry, including, but not limited to any manner within Big Fish games and advertising or promotions of Big Fish games (“Promotional Materials)” and the Promotion, in any channel, platform, format and media, now existing or later developed (the “BFG Uses”). The BFG Uses may include, but are not limited to, any of the following: featuring the Entry in the Big Fish games “Big Fish Casino” and/or “Jackpot Magic Slots” and Big Fish newsletters. Entrant understands and agrees that there are no limitations on the BFG Uses, except that they shall be related to Big Fish Casino and Jackpot Magic Slots. The BFG Uses may occur at any time before, during or after the Promotion, may be unrelated to the Promotion, on any media, and throughout the world. Big Fish shall have exclusive control and discretion over the manner and extent to which the Entry and Entrant’s name are used in the BF Uses.
Big Fish has no obligation to use the Entry or Entrant’s name and may discontinue any use at any time, for any reason, without notice to Entrant. Big Fish’s use of the Entry will not require payment to any person or entity and does not require approval or consent by any other person or entity. Entrant has no right to review or approve the BFG Uses before they are used by Big Fish or at any other time, and that Big Fish has no liability to Entrant for any editing or alteration of the Entry, Entrant’s name, or the BFG Uses, or for any distortion or other effects resulting from Big Fish’s editing, alteration, or use of the Entry, Entrant’s name, or the BFG Uses, or Big Fish’s presentation of the Entry. Any acknowledgment or credit of Entrant in connection with the BFG Uses, if any, shall be determined by Big Fish in Big Fish’s sole discretion.
Ownership. Big Fish shall own and retain all right, title, and interest in the following: (i) any works created by or on behalf of Big Fish in which the Entry is used; (ii) the Big Fish Casino and Jackpot Magic Slots games; (iii) the Promotion; (iv) Promotional Materials; and (v) any works, names, trademarks, or other assets created in connection with the BFG Uses (collectively, “Big Fish IP”). Any rights not specifically granted or conveyed to Entrant in the Agreement are retained by Big Fish as Big Fish IP.
Entrant represents to Big Fish that Entrant is the sole owner of the intellectual property rights in the Entry. Entrant shall own and retain all right, title, and interest in the Entry, subject to Big Fish’s IP and the terms of these Official Rules. Entrant hereby disclaims any rights in the Big Fish IP and agrees not to assert or attempt to exercise any ownership or other right or interest in the Big Fish IP. Any rights or interests Entrant may have in the Big Fish IP, Entrant hereby fully assigns without restriction to Big Fish.
Additional Terms. To the maximum extent permitted by applicable law, Big Fish reserves the right, in its sole discretion, to change these rules or cancel this Promotion at any time, or to modify, terminate, or suspend this Promotion should viruses, worms, bugs, unauthorized human intervention or other causes beyond Big Fish’s control corrupt or impair the administration, security, fairness or proper play of this Promotion. Big Fish is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission related to this Promotion, nor is it responsible for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any attempted game coupon redemption on account of technical problems or traffic congestion on the Internet or at any web site. Big Fish is not responsible for injury or damage to any participant’s or any other computer or mobile device resulting from downloading any materials in connection with this Promotion. Big Fish reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the operation of this Promotion or web site; to be acting in violation of these rules; or to be acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or similar methods while participating in this Promotion will void all such attempts to participate in this Promotion. Only the Prize stated herein will be awarded. In the event any technical errors occur in the selection of winner and more Prizes are claimed than the number of Prizes being awarded as provided herein, Big Fish reserves the right to award the Prizes by random drawing from among all eligible claimants.
Miscellaneous. This Promotion is governed by the laws of the United States. By entering, Entrants agree to be bound by these rules. No transfer, assignment, cash redemption or substitution of Prize is permitted except by Big Fish due to Prize availability and then with a prize of equal or greater value. By accepting a Prize, each winner agrees (for himself or herself and his or her heirs) that Big Fish, Facebook, and their affiliates, employees, officers, directors, and agents will have no liability, and will be released and held harmless by such winner for any liability, loss, injury or damage to property or to person, including death, and reasonable attorney’s fees and court costs, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the Prize or participation in this Promotion, even if caused or contributed to by the negligence of Big Fish or Facebook. Entrants agree that the decisions of Big Fish related to this Promotion are final and binding. By participating in this Promotion, winner consents to the use of his or her name, photograph and/or likeness in any manner and in any medium for promotional purposes without additional notice or compensation, except where prohibited by law.
