Big Fish Points Program Terms of Use

These Big Fish Points Program Terms of Use (“Points Program Terms”) apply to your access to and participation in the Big Fish Points Program (“Points Program”), which is operated by Big Fish. The Points Program is a Big Fish Offering (as defined in the Big Fish Terms of Use), and these Points Program Terms are in addition to, and not in lieu of, your rights and obligations under the Big Fish Terms of Use (“Big Fish Terms of Use”). Capitalized terms not defined in the Points Program Terms have the meanings assigned to them in the Big Fish Terms of Use. To the extent there is a conflict between these Points Program Terms and the Big Fish Terms of Use, these Points Program Terms will govern such conflict.
Please read these Points Program Terms carefully. By participating in the Points Program, you agree to these Points Program Terms and the Big Fish Terms of Use. If you do not agree to these Points Program Terms and the Big Fish Terms of Use, do not participate in the Points Program or use other Big Fish Offerings. 1. Program Overview
Big Fish is offering and operating the Points Program, a loyalty and rewards program that allows Big Fish account holders to earn and redeem Points Program points (“Big Fish Points”) and other incentives. Big Fish Points are earned by completing the activities specified in Section 4 below or as otherwise instructed by Big Fish. Big Fish Points are not redeemable for cash, are not transferable, and may only be redeemed as specified in Section 5 of these Points Program Terms or as otherwise directed by Big Fish.
2. Modification
Big Fish reserves the right to change or eliminate the Points Program and all or any portion of these Points Program Terms or any policy pertaining to the Points Program at any time and in its discretion, including our right to discontinue or change the benefits or change the expiration date of Big Fish Points received under the Points Program, merge the Points Program with another loyalty or rewards program, or to adjust how Big Fish Points are earned, calculated, or redeemed. If we make changes, we will post the amended Points Program Terms and update the “Last Modified” date above. We may also attempt to notify you in other ways. Unless we say otherwise, the amended Points Program Terms will be effective immediately and your continued participation in the Points Program after the amended Points Program Terms are posted will confirm your acceptance of the changes. If you do not agree to the amended Points Program Terms, you must stop participating in the Points Program.
3. Joining the Points Program
All Big Fish accounts are enrolled in the Points Program, and there are no membership fees associated with the Points Program. If you have a Big Fish account, you can view how many Big Fish Points you have earned and redeemed at https://shop.bigfishgames.com/big-fish-points/.
4. Earning Big Fish Points
Big Fish Points may only be earned as stated in this Section and may not be purchased.
- Earning Big Fish Points on purchases. When you make a purchase through eligible Big Fish Offerings, you will earn Big Fish Points based on a percent of the purchase price. Any Big Fish Points to be awarded will be rounded to the nearest whole number.
For most users, you are limited to earning Big Fish Points on 1% of the purchase price. If you make the purchase from an account with an active Big Fish Game Club subscription, however, you will earn Big Fish Points on 15% of the purchase price. Taxes, fees, and discounts from redeemed Big Fish Points are excluded and ineligible for earning Big Fish Points on. Purchases from Restricted Offerings are also ineligible for earning Big Fish Points on.
As an example, if you make an eligible purchase for $39.98 (before taxes and fees) and your account does not have an active Big Fish Game Club subscription, you will earn Big Fish Points from that purchase. If your account did have an active Big Fish Game Club subscription, you would instead earn Big Fish Points on the purchase.
- Earning Big Fish Points from Big Fish Game Club. If you have an active Big Fish Game Club subscription, you will earn 699 Big Fish Points each time your paid subscription renews. For more information about Big Fish Game Club see Big Fish Game Club.
5. Using or Redeeming Points Program Big Fish Points
Big Fish Points may be redeemed upon checkout at a rate of $0.01 USD per Big Fish Point on purchases through eligible Big Fish Offerings. Big Fish Game Club subscriptions and purchases from Restricted Offerings are ineligible and Big Fish Points cannot be redeemed for such purchases. To redeem Big Fish Points, log into your Big Fish account and go through the checkout process.
Big Fish Points closest to expiring will automatically be applied to purchases first.
Big Fish Points cannot be used on previous orders. Big Fish Points, discounts, and special offers are non-transferrable, non-assignable, and may not be shared. Big Fish Points are promotional and have no cash value. Your Big Fish Points and your Big Fish account are personal to you and may not be sold, transferred (by operation of law or otherwise) or assigned to, or shared with, family, friends, or others, or used by you for any commercial purpose. You are responsible for any taxes related to your participation in the Points Program.
6. Points Expiration
UNUSED BIG FISH POINTS EXPIRE TWO YEARS FROM THE DATE THEY ARE EARNED. EXPIRED BIG FISH POINTS ARE DEDUCTED FROM YOUR BIG FISH POINTS BALANCE.

7. Returns and Big Fish Points Refunds
If you return purchases that you purchased in whole or in part with Big Fish Points, you will be refunded the amount you paid (excluding the value of the Big Fish Points). So, if you place an order totaling $100 for one item and redeemed Big Fish Points to receive a $10 discount, then we will refund $90 to your original method of payment. However, Big Fish will not credit the Big Fish Points redeemed for the refunded purchase back to your account. Note that if you purchase multiple items in a single transaction your redeemed Big Fish Points are applied proportionally to each item. A return of any one item will result in a refund of the amount you paid (excluding the value of the proportionally-applied redeemed Big Fish Points). If you obtain a refund for a product you purchased using your Big Fish account, any Big Fish Points you accrued from the purchase of the returned item will automatically be deducted from your Big Fish account.
8. Miscellaneous
Big Fish reserves the right to suspend or terminate your Big Fish account and your participation in the Points Program, with or without notice, if Big Fish determines in its sole discretion that you have violated these Points Program Terms or that the use of your Big Fish account or your participation in the Points Program is unauthorized, deceptive, fraudulent, or otherwise unlawful. Additionally, if your Big Fish account is suspended or terminated for any other reason it will result in the suspension or termination of your participation in the Points Program. If your participation in the Points Program is terminated, you will not be able to redeem any accumulated Big Fish Points.
